These Terms and Conditions (“Terms”) govern your access to and use of Wisefork, including our mobile application, website, content, features, recommendations, recipes, cost comparisons, nutrition estimates, grocery tools, and related services (collectively, the “Service”).

By accessing or using Wisefork, you agree to these Terms. If you do not agree, do not use the Service.

1. What Wisefork Does

Wisefork helps users discover restaurant-inspired meals they can cook at home, compare estimated takeout or delivery costs against estimated home-cooking costs, view estimated nutrition information, and select groceries or supplies for preparing meals.

Wisefork may show restaurant names, restaurant-inspired menu items, AI-generated food images, rewritten menu-style descriptions, recipe suggestions, grocery estimates, cooking guidance, and nutrition estimates. Unless clearly stated otherwise, Wisefork is not a restaurant, food delivery platform, grocery retailer, healthcare provider, dietitian, nutritionist, or medical provider.

2. No Restaurant, Delivery Platform, or Grocery Platform Affiliation

Wisefork is not affiliated with, sponsored by, endorsed by, or officially connected to any restaurant, food delivery platform, grocery platform, grocery retailer, brand, or third-party service shown in the app unless expressly stated in writing.

Restaurant names may be used only to identify restaurants, cuisines, menu inspiration, or comparable meal ideas. Restaurant names, menu references, cuisine references, and meal inspirations are provided for informational and discovery purposes only.

Wisefork does not claim that its recipes are official restaurant recipes, exact copies, secret recipes, or authorized versions of any restaurant’s menu items.

3. Restaurant-Inspired Recipes

Wisefork may generate or display recipes inspired by publicly recognizable food styles, restaurant menu items, cuisines, flavor profiles, or user preferences. These recipes are intended to be home-cook versions and may differ from the restaurant item in ingredients, preparation method, taste, portion size, nutrition, allergens, price, and appearance.

You should not rely on Wisefork as a source of official restaurant recipes or official restaurant nutrition information.

4. AI-Generated Images and Rewritten Descriptions

To reduce intellectual property risk and provide an original user experience, Wisefork may use AI-generated food images, licensed images, partner-provided images, or original images. AI-generated images are illustrative only and may not match the exact appearance of a restaurant item or the final cooked meal.

Menu item descriptions, recipe descriptions, and food summaries may be rewritten, remixed, generated, or edited by Wisefork or its technology providers. These descriptions are intended to describe similar meals or cooking ideas and are not official restaurant menu descriptions unless clearly identified as such.

5. Cost Comparison and Estimated Savings

Wisefork may display a cost comparison between a takeout, pickup, restaurant, or delivery meal and an estimated home-cooking cost. These comparisons are estimates only.

The “takeout cost” or “restaurant cost” estimate may include the menu item price and may also include a portion or estimate of platform-related fees that a user may otherwise encounter on third-party delivery platforms, including delivery fees, service fees, small order fees, marketplace fees, processing fees, taxes, tips, markups, or other charges. These fees may vary widely by platform, location, restaurant, time, order size, subscription status, promotions, and user account.

The “home-cook cost” estimate may be based on estimated grocery ingredient costs, package sizes, portion allocation, selected grocery store, substitutions, regional pricing, availability, taxes, and other factors. It may not represent the exact amount you will pay at checkout.

Any “Estimated Savings” shown by Wisefork is an estimate and not a guarantee. Actual savings may be higher, lower, or unavailable depending on restaurant pricing, delivery fees, grocery prices, taxes, tips, substitutions, portion sizes, ingredient waste, promotions, discounts, and other factors.

6. Nutrition Estimates

Wisefork may provide calories, protein, sodium, macronutrients, ingredient information, or other nutrition-related estimates. These values are estimates only and may be based on ingredients, serving sizes, public information, standard nutrition databases, AI-generated approximations, or third-party data.

Wisefork’s nutrition information is not medical advice, dietary advice, or a substitute for advice from a physician, registered dietitian, nutritionist, or other qualified healthcare professional.

Nutrition estimates may be inaccurate or incomplete. Actual nutrition values may vary based on ingredient brands, preparation methods, cooking oils, sauces, substitutions, portion sizes, and restaurant-specific preparation.

If Wisefork displays a “Nutrition Estimate,” “Estimated Nutrition Difference,” or similar comparison between a restaurant-style meal and a home-cooked version, the comparison is approximate and should not be treated as verified restaurant nutrition data.

7. Allergens, Dietary Restrictions, and Food Safety

Wisefork may identify possible ingredients, allergens, dietary categories, or food preferences, but we do not guarantee that meals, recipes, groceries, or suggested substitutions are safe for your allergies, intolerances, medical conditions, pregnancy, dietary restrictions, religious restrictions, or personal needs.

You are responsible for checking ingredient labels, grocery packaging, restaurant disclosures, allergen statements, and professional guidance before preparing or consuming any food.

Wisefork is not responsible for allergic reactions, foodborne illness, adverse health outcomes, cooking mistakes, unsafe food handling, ingredient substitutions, cross-contamination, or reliance on inaccurate or incomplete nutrition or allergen information.

8. Grocery, Supply, and Third-Party Ordering Tools

Wisefork may allow you to select supplies, build a grocery list, view estimated grocery costs, or connect with third-party grocery, delivery, or affiliate partners. Third-party services are governed by their own terms, pricing, privacy policies, refund policies, delivery rules, and availability.

Wisefork does not control third-party inventory, pricing, substitutions, delivery timing, grocery quality, refunds, or fulfillment.

If Wisefork earns a commission, referral fee, affiliate payment, advertising fee, or other benefit from a grocery partner, product recommendation, or third-party link, we may disclose this within the app or near the relevant recommendation where required by law.

9. Accounts and User Information

You may need to create an account to access certain features. You agree to provide accurate information and keep your login credentials secure. You are responsible for activity under your account.

You may not use Wisefork for unlawful, deceptive, abusive, automated, infringing, or harmful activity.

10. Subscriptions, Purchases, and Payments

Wisefork may offer free features, paid features, subscriptions, trials, promotional offers, or one-time purchases. Pricing, billing periods, renewal terms, cancellation rules, and refund availability will be shown at purchase or governed by the applicable app store or payment provider.

If you purchase through the Apple App Store, Google Play, Stripe, or another payment provider, your purchase may be processed by that provider and subject to its payment terms. Wisefork may not be able to provide refunds directly for purchases processed by third parties.

Subscriptions may automatically renew unless canceled before the renewal date in accordance with the applicable app store or payment provider rules.

11. User Content and Preferences

You may provide preferences, dietary goals, favorite restaurants, grocery selections, notes, images, feedback, reviews, or other content (“User Content”). You retain ownership of your User Content, but you grant Wisefork a worldwide, non-exclusive, royalty-free license to use, host, process, reproduce, modify, analyze, and display your User Content as needed to operate, improve, personalize, secure, and promote the Service.

You represent that you have the rights needed to provide any User Content you submit and that it does not violate law or third-party rights.

12. Intellectual Property

Wisefork, including its name, branding, interface, software, original content, design, recipes, descriptions, databases, recommendations, cost-comparison methods, and features, is owned by Wisefork or its licensors and is protected by intellectual property and other laws.

You may not copy, scrape, reverse engineer, resell, reproduce, distribute, or create derivative works from Wisefork except as permitted by these Terms or applicable law.

All third-party names, restaurant names, platform names, product names, and marks belong to their respective owners. Their appearance in Wisefork does not imply affiliation, sponsorship, or endorsement.

13. Copyright and IP Complaints

If you believe content in Wisefork infringes your copyright, trademark, publicity rights, or other intellectual property rights, contact us at [Insert IP Contact Email] with:

• your name and contact information;

• identification of the content at issue;

• a description of the rights you believe are infringed;

• evidence of your ownership or authorization;

• the location of the content in Wisefork; and

• a statement that the information you provide is accurate.

We may remove or restrict content at our discretion while we review a complaint.

14. Acceptable Use

You agree not to:

• use Wisefork for unlawful, misleading, abusive, or harmful purposes;

• copy, scrape, harvest, or extract Wisefork data without permission;

• attempt to access non-public systems or interfere with the Service;

• upload malicious code or harmful content;

• impersonate another person or misrepresent your affiliation;

• use Wisefork to infringe intellectual property rights;

• rely on Wisefork as medical, legal, financial, nutritional, or safety advice; or

• use automated tools to overload, mine, or reverse engineer the Service.

  
  

15. Third-Party Services and Links

Wisefork may contain links, integrations, recommendations, pricing, data, or content from third-party services. We do not control and are not responsible for third-party services, including their accuracy, availability, security, pricing, data practices, policies, or fulfillment.

Your use of third-party services is at your own risk and subject to their terms and privacy policies.

16. App Store Terms

If you download Wisefork through the Apple App Store, Google Play, or another app marketplace, you also agree to the applicable marketplace terms. The app marketplace is not responsible for providing maintenance, support, refunds, or claims related to Wisefork except as required by its own terms or applicable law.

17. Disclaimers

Wisefork is provided “as is” and “as available.” We do not guarantee that the Service will be uninterrupted, error-free, accurate, complete, secure, current, or suitable for your specific needs.

We do not guarantee:

• exact restaurant prices;

• exact delivery fees or platform fees;

• exact grocery prices;

• exact savings;

• exact nutrition values;

• exact allergen identification;

• exact recipe outcomes;

• exact restaurant similarity;

• item availability;

• third-party delivery or grocery fulfillment; or

• that any meal will meet your health, dietary, religious, pregnancy, fitness, or medical needs.

  
  

18. Limitation of Liability

To the maximum extent permitted by law, Wisefork and its owners, officers, employees, contractors, partners, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, lost savings, health outcomes, allergic reactions, food safety issues, grocery substitutions, third-party fees, delivery issues, or reliance on estimates.

To the maximum extent permitted by law, Wisefork’s total liability for any claim relating to the Service will not exceed the greater of: (a) the amount you paid Wisefork for the Service in the three months before the claim arose; or (b) $100 CAD/USD.

Some jurisdictions do not allow certain limitations of liability, so some limitations may not apply to you.

19. Indemnification

You agree to defend, indemnify, and hold harmless Wisefork and its owners, officers, employees, contractors, partners, service providers, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from your use of the Service, your User Content, your violation of these Terms, your violation of law, or your infringement of third-party rights.

20. Termination

We may suspend or terminate your access to Wisefork at any time if we believe you violated these Terms, created risk for Wisefork or others, or used the Service in a harmful or unlawful way.

You may stop using Wisefork at any time. Certain provisions of these Terms will survive termination, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute provisions.

21. Changes to the Service and Terms

We may update Wisefork, add or remove features, modify pricing, change estimates, update data sources, or revise these Terms. If changes are material, we may provide notice through the app, website, email, or other reasonable means.

Your continued use of Wisefork after updated Terms become effective means you accept the updated Terms.

22. Governing Law and Disputes

These Terms are governed by the laws of [Insert Province/State/Country], without regard to conflict-of-law rules.
